LETTERS to the EDITOR - Luschas: HB1198 would give Brandon a voice in Data Center approval process

HB1198 was introduced by Rep. John Sjaarda last week. The bill states that a proposed high energy use facility, e.g. a data center, within 1 mile of an adjacent jurisdiction must obtain a use permit from that adjacent jurisdiction. This bill’s intention is to give the City of Brandon a voice in the approval process for a use permit for the Data Center that is supposed to be built in Brandon’s backyard. Brandon residents currently have no say in the Data Center discussion because the proposed location, even though it is less than half a mile from Brandon homes, is solely in the jurisdiction of Sioux Falls.

We are asking for help with supporting this bill as it moves through the Legislature – both in-person and email supporters. At the time of the writing of this letter, we do not know to which committee this bill will be assigned, nor when exactly it will be heard in committee.
