THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. November 5, 2019, pursuant to adjournment on October 29, 2019. Commissioners present were: Barth, Bender, Beninga, and Karsky. Commissioner Heiberger was absent. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

Carey Deaver, Human Resources Director, gave a briefing on a Financial Renewal Amendment to the Administrative Services Agreement for the county health plan with UMR, Inc. UMR is the third party administrator who processes payments and explanations of benefits for the County. The fees for 2020 will increase by 2% from 2019. MOTION by Beninga, seconded by Karsky, to approve the Financial Renewal Amendment to the Administrative Services Agreement with UMR, Inc. effective January 1, 2020.  4 ayes.
PLANNING & ZONING NOTICE
Kevin Hoekman, Planner, gave the first reading and requested authorization for the Auditor to publish a Notice of Hearing for a major amendment to MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County. The amendment pertains to the High Prairie Ranch Planned Development District, to amend the subarea designation of the property described as Lots 18 & 18A High Prairie Ranch Addn., NW1/4 all in Section 8-T102N-R49W from Subarea C to Subarea D. MOTION by Karsky, seconded by Barth, to authorize the Auditor to publish a Notice of Hearing for November 26, 2019, to consider major amendment #19-05, An Ordinance Amending The 1990 Revised Zoning Ordinance For Minnehaha County By Amending Certain Property Within The High Prairie Ranch Planned Development District.  4 ayes.
Scott Anderson, Planning Director, was present for the first reading of an amendment to the 2002 Revised Zoning Ordinance for Minnehaha County and the City of Sioux Falls for Rezone #19-07. Mr. Anderson explained that the applicant of the rezone contacted the County on November 4, 2019, to withdraw his request for a rezone. The area will be annexed into the City of Sioux Falls. Therefore, the applicant will instead request the rezoning through the City. Chair Bender acknowledged the applicant’s withdrawal of the rezoning request.
Chair Bender announced that due to an oversight regarding the placement of a public hearing on the agenda, the public hearing for amendments to the Ordinance for Licensing Surface Ambulance Service in Minnehaha County would be re-noticed and rescheduled for a later date.
AMENDMENT
DJ Buthe, Highway Superintendent, gave a briefing on Amendment No. 2 to the Professional Services Agreement between Minnehaha County and Infrastructure Management Services for payment management services. The amendment would allow for a three year extension through the year 2022 for pavement management services. This would include road sampling in 2020 and three years of analysis and optimization recommendations. The cost of the amendment is not to exceed $96,326.88. MOTION by Karsky, seconded by Beninga, to authorize the Chair to sign Amendment No. 2 to the Professional Services Agreement between Minnehaha County and Infrastructure Management Services for a three year extension at a cost not to exceed $96,326.88.  4 ayes.
TAX DEED
Bob Litz, Auditor, reported on the October 26, 2019, tax deed sale. Ten percent (10%) down payments were made for Tax Deed #2612 RDID #27054, bid amount of $10,000, and Tax Deed #2605 RDID #65784, bid amount of $85,000. Mr. Litz requested accepting the highest bids for each property; and requested approval of a resolution authorizing the Auditor to abate all outstanding taxes, interest, penalties, and municipal nuisance special assessments and to authorize the Treasurer to issue a quit claim deed.  MOTION by Barth, seconded by Beninga, to accept the high bids received for Tax Deed #2612 and Tax Deed #2605, and to approve Resolution MC19-52 and Resolution MC19-53. By roll call vote: 4 ayes.
RESOLUTION OF SALE

WHEREAS, The County Auditor offered for sale on October 26, 2019, at public auction, the following described Tax Deed Property pursuant to SDCL 6-13: 
Tax Deed #2605; RDID #65784; 2308 E Sioux Street, Sioux Falls; legally described as Tract D of Mount Zion Addition to the city of Sioux Falls, Minnehaha County, South Dakota, according to the recorded plat thereof; sold to CAM Companies, LLC, 421 N. Phillips Ave, Unit 411, Sioux Falls, South Dakota, 57105 for $85,000; 
NOW, THEREFORE, BE IT RESOLVED by the Minnehaha County Commission that this sale be approved as set forth above and that the Minnehaha County Treasurer is hereby authorized to issue Quit Claim Deed thereto and the Minnehaha County Auditor is authorized to abate all outstanding taxes, interest, and penalties levied against this property.

AGREEMENT
Scott Anderson, Planning Director, gave a briefing on an agreement between Minnehaha County and Pictometry International Corp. for the 2020 Pictometry Acquisition Project. The term of the agreement would be three years beginning in January 2020. The cost to Minnehaha County would be $42,141.50 annually over three years. The City of Sioux Falls’ share of the cost would be $23,428.75 annually to be invoiced by the County and paid by the City in August 2020, 2021, and 2022. MOTION by Beninga, seconded by Karsky, to authorize the Chair to sign the Pictometry Acquisition Project agreement with Pictometry International Corp. at an annual cost to Minnehaha County of $42,141.50 beginning January 1, 2020 through December 31, 2022.  4 ayes.
BRIEFING
Jason Gearman, Emergency Management Director, gave a briefing on the performance work plan requirements and objectives of the Local Emergency Management Performance Grant.
AGREEMENTS
Joe Bosman, Deputy Sheriff Captain, presented a Hold Harmless Agreement between Minnehaha County and the South Dakota Department of Health (SDDOH) for the LIFEPAK CR2 defibrillator. The Sheriff’s Office may participate in a new cooperative initiative project to equip Sheriff’s Office vehicles with the next generation of automated external defibrillators (AED). The project is funded by the Helmsley Charitable Trust with the SDDOH providing oversight and distribution. Approximately 25 new AED devices would be supplied to the Sheriff’s Office through the project at no cost to the County. To participate in the project, the Sheriff’s Office fulfilled the requirement of attending an AED “train the trainer” session. MOTION by Karsky, seconded by Beninga, to authorize the Chair to sign the Hold Harmless Agreement between Minnehaha County and the South Dakota Department of Health for the LIFEPAK CR2 defibrillator.  4 ayes.
Joe Bosman, Deputy Sheriff Captain, presented the 2020 Police Service Agreements. The hourly rate will increase from $34.72 in 2018 to $35.50 in 2019. All agreements remain the same in the number of hours and scope of services provided by the Minnehaha County Sheriff’s Office. MOTION by Beninga, seconded by Barth, to authorize the Chair to sign the 2020 Police Service Agreements between Minnehaha County and the Cities of Baltic, Colton, Crooks, Dell Rapids, Garretson, Hartford, Humboldt, and Valley Springs.  4 ayes.
LIAISON REPORT
Commissioner Barth reported on attending an Egyptian Trade Delegation Meeting on November 4, 2019, where the Egyptian Ambassador looked into buying agricultural products from South Dakota Farmers.
Commissioner Beninga reported on attending the City of Hartford Planning and Zoning Meeting on November 4, 2019, where the public was provided the opportunity to speak on a possible joint jurisdiction between Minnehaha County and the City.
Commissioner Bender reported on a Jail Leadership Team Meeting noting that the jail expansion project is on time and under budget.
NEW BUSINESS
Commissioner Karsky stated that next Monday, November 11, 2019, is Veterans Day. A ceremony will be held at Lincoln High School at 10:30 a.m.
Bob Litz, Auditor, stated that he and an Auditor’s Office employee will be attending the 2019 County Auditor Election Workshop in Pierre where representatives and speakers will be present from the Department of Homeland Security, ES&S, Election Services, and Sea Change.
OLD BUSINESS
Bob Litz, Auditor, stated that certain properties on Dubuque Ave had been taxed in the wrong school district between 2015 and 2019 have been corrected as of November 1, 2019. Additionally, letters were sent to tax payers that were affected by the error.
Scott Anderson, Planning Director, reported on attending the City of Hartford Planning and Zoning Meeting on November 4, 2019, regarding the possible joint jurisdiction between Minnehaha County and the City. Another public meeting is expected to be held in January.
MOTION by Barth, seconded by Karsky, to recess the Minnehaha County Commission Meeting at 10:03 a.m.  4 ayes.
MOTION by Karsky, seconded by Barth, to reconvene the Minnehaha County Commission Meeting at 10:14 a.m.  4 ayes.
MOTION by Barth, seconded by Beninga, to enter into Executive Session pursuant to SDCL 1-25-2 (1), (3) and (4).  4 ayes.
MOTION by Karsky, seconded by Barth, to adjourn.  4 ayes.
The Commission adjourned until 9:00 a.m. on Tuesday, November 12, 2019.
