THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. March 10, 2020, pursuant to adjournment on March 3, 2020. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.
MOTION by Beninga, seconded by Barth, to amend the agenda to correct a typographical error in Item 6q, Abatements Recommended for Approval, to correct Parcel ID incorrectly listed as 58549 to the correct Parcel ID, 58489.  5 ayes.

Justin Bentaas, Sioux Falls Area Chamber of Commerce Public Affairs & Research Manager, read the 2020 St. Patrick’s Day Proclamation. The proclamation will be read by Commissioner Barth during the painting of the shamrock ceremony at 11:00 a.m. on Saturday, March 14, 2020. MOTION by Heiberger, seconded by Barth, to issue the 2020 St. Patrick’s Day Proclamation for O’Minnehaha County.  5 ayes.
BRIEFINGS & PRESENTATIONS
Jason Gearman, Emergency Management Director, gave a briefing on the flood forecast, actions taken by Emergency Management in preparation, and actions taken by other agencies. Sandy Frentz, City of Sioux Falls Public Health Manager, gave an update on the coordination and planning involved with the Coronavirus (COVID-19), as well as current statistics.
Dr. Kenneth Snell, Coroner/Medical Examiner, presented on the Minnehaha County Coroner’s Office highlighting the following areas: 2019 case data, the causes of death, increased costs in toxicology and transport, savings in radiology, and the trend of an increasing case load.
Kori Baade, Sioux Falls Area Humane Society Executive Director, and Lex McKee, Humane Officer, presented on the Sioux Falls Area Human Society services and highlighted areas such as daily intakes, medical services, offered programs, community concerns, 2019 statistics, humane officers, partnerships, and funding.
AGREEMENT
Jamie Phelps, Quality Assurance and Improvement Manager, presented the annual renewal agreement between Minnehaha County and Lincoln County for Human Services caseworker services. Lincoln County will reimburse Minnehaha County for its services at a rate of $6,766.81 per month. The total projected cost of the agreement is $81,201.71. MOTION by Barth, seconded by Karsky, to approve the Agreement for Casework Services between Minnehaha County and Lincoln County beginning on April 1, 2020 through March 31, 2021.  5 ayes.
RESOLUTION
Kevin Hoekman, Planner, presented a resolution for a building permit fee schedule increase. Due to the recent adoption of the 2018 International Building Codes, build permit fee increases are needed to support the cost of the implementation of the codes. The most recent fee schedule was approved in 2015. Instead of a flat rate percentage increase across all construction finish categories, a permit fee structure based on finished space versus unfinished space, such as an attached garage, was proposed. The proposed fees were presented to the Sioux Empire Home Builders Association. MOTION by Heiberger, seconded by Barth, to approve Resolution MC20-14, to establish building permit fees. By roll call vote: 5 ayes.
RESOLUTION MC20-14
WHEREAS, Minnehaha County has adopted the 2018 Editions of the International Building Code, International Residential Code, and International Existing Building Code; and 
WHEREAS, Section 109.2 of the International Building Code, and Section R108.2 of the International Residential Code require the County as the governing authority to establish a permit fee schedule; and 
WHEREAS, the permit fees are utilized by the County to administer the International Building Code, International Residential Code, and International Existing Building Code. 
NOW, THEREFORE, BE IT RESOLVED that the Minnehaha County Board of Commissioners establishes the following building permit fees for Minnehaha County:

AGREEMENT
DJ Buthe, Highway Superintendent, presented a Right-Of-Way Purchase Agreement for property owned by Donald W Pierret. In conjunction with Banner Associates, Inc., the Highway Department will rebuild three culverts in various locations. Additional right-of-way is needed to meet the current standard of 100 total feet. MOTION by Beninga, seconded by Barth, to approve the Right-Of-Way Purchase Agreement with Donald W Pierret for a total of $4,558.00 for the property legally described as Lot H-1 in Tract 2 of Pierret’s Addition in the West Half (W½) of Section 5, Township 104 North, Range 47 West of the 5th P.M., Minnehaha County, South Dakota; a total of 0.53 acres.  5 ayes.
PLAT
DJ Buthe, Highway Superintendent, presented a plat subdividing the land at the Minnehaha County owned gravel pit. The property is approximately 116.7 acres located on County Highway 140. The purpose of subdividing the property is to allow for the surplus of a certain portion of the gravel pit referred to as Tract 1. The 78 acres of land to the north of Tract 1 will continue to be used by the Highway and Sheriff’s Departments. Soil borings were obtained to assist in determining the volume and quality of aggregate remaining within Tract 1. Mr. Buthe noted that the first page of the plat had a typographical error. The roadway to the east side of Tract 1 was listed as 476th Avenue instead of 467th Avenue. Therefore, the first page will be replaced with the corrected information. MOTION by Karsky, seconded by Barth, to authorize the Chair to sign the plat with a legal description of Tract 1, Sierra Addition in the SE¼ of the SE¼ of Section 6, Township 101 North, Range 50 West of the 5th P.M., Minnehaha County, South Dakota; for the purpose of subdividing the Minnehaha County gravel pit.  5 ayes.
LEGISLATIVE UPDATE
Craig Dewey, Assistant Commission Administrative Officer, gave an update and status report on the 2020 Legislative Session bills that impact Minnehaha County highlighting Senate Bill (SB) 2, SB 35, SB 46, SB 157, and SB 70.
LIAISON REPORT
Commissioner Karsky reported on the March 10, 2020, Public Defender Advisory Board Meeting. The Public Defender’s Office budget is on track and the annual report has been drafted. Two items Commissioner Karsky noted were 1) concerns with staffing and space needs and 2) concerns that individuals are being jailed if they must go before a judge for not paying child support.
Commissioner Heiberger reported on attending the 2020 National Association of Counties Legislative Conference with Commissioner Barth in Washington, D.C. last week. Commissioner Heiberger attended various committee meetings including the Justice & Public Safety Committee. President Donald Trump and General Colin Powell spoke during the conference. Commissioner Barth spoke on attending sessions during the conference on topics such as new benefits available to veterans, veteran suicide rates, medical benefits being lost by veterans if jailed, counties with military bases, and recycling.
Commissioner Barth reported that the Planning Commission approved roller coaster for Wild Water West has been appealed by the Blue Haven Barn.
Commissioner Beninga reported that fifteen applications will be reviewed on March 10, 2020, for the remodel/replacement of the Highway Department’s facility.
