THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. March 3, 2020, pursuant to adjournment on February 25, 2020. Commissioners present were: Bender, Beninga, and Karsky. Commissioners Barth and Heiberger were absent. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

Commander Ken Teunissen, Department of the Dakotas Military Order of the Purple Heart, presented a Purple Heart Recognition Flag to Senior Deputy State’s Attorney Margaret Gillespie for her father’s military service.

PLANNING & ZONING NOTICE

Kevin Hoekman, Planner, gave the first reading and requested authorization for the Auditor to publish a Notice of Hearing for an amendment to MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County, to rezone from the A-1 Agricultural District to the C Commercial District on property legally described as S1/2 SE1/4 (Ex. LIEN COMPROMISE

Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 30084 in the amount of $3,504.83. The lien represents Public Defender and Poor Relief services provided to the applicant and his ex-spouse between May 1993 and October 2015. The applicant and his ex-spouse were married in May 1995, separated in September 1997, and divorced in April 2010. The applicant acknowledged being responsible for $2,602.23 of the lien. The remaining $902.60 being the responsibility of the applicant’s ex-spouse. The applicant is in the process of purchasing a home with a closing date on or before July 26, 2020. Additionally, the applicant reported an income of $40,440.00 with a 2019 tax refund of $2,787.00. The applicant’s listed assets totaling $6,500.00 and liabilities totaling $8,005.00. The compromise request was to release the applicant from the lien upon payment of $1,000.00 leaving $902.60 in the name of the applicant’s ex-spouse. MOTION by Karsky, seconded by Beninga, to approve Resolution MC20-10. By roll call vote: 3 ayes.

RESOLUTION  MC20-10

WHEREAS, a County Aid Lien in the amount of $3,504.83, purports to exist in favor of Minnehaha County and against DPNO 30084 as Lienee, and 

WHEREAS, said lienee has filed an application with the County Auditor stating such facts as provided for by Law,

NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chair of the County Board and the County Auditor to execute the following:

Compromise and release the applicant from DPNO 30084 upon payment of $1,000.00, and leave DPNO 30084 in the name of the applicant’s ex-spouse in the amount of $902.60.

PROCLAMATION

Kris Graham, Southeastern Behavioral HealthCare CEO; Kim Hansen, Director of Operations Community Support Services Division and Mobile Crisis Team; Debbie Faini, Alternative Sentencing Program; and Melissa Tauer, Clinical Director of Adult Services, presented on the following programs: the Early Childhood Mental Health Collaborative, Mental Health Court, the Mobile Crisis Team, and the Public Defender’s Alternative Sentencing Program.

Jamie Gravett, Juvenile Detention Center Director, presented on the Juvenile Detention Center including detention alternatives, accomplishments, projects, and challenges/concerns.

BID AWARD

DJ Buthe, Highway Superintendent, reported on the February 19, 2020, bid opening for Bid #20-03, Highway Project MC19-07, Structure 50-206-100 Replacement. The following bids were received: Swingen Construction Company, $997,600.00; Graves Construction Company, Inc., $1,023,749.59; Prahm Construction, Inc., $1,095,945.60; and Nolz Dragline and Construction, Inc., $1,107,903.48. Staff recommended awarding the bid to the low bidder, Swingen Construction Company. The engineer’s estimate was $1,294,454.75. The contract would allow 75 working days for project completion with a completion date of November 13, 2020. MOTION by Beninga, seconded by Karsky, to award Bid #20-03, Highway Project MC19-07, Structure 50-206-100 Replacement, to Swingen Construction Company in the amount of $997,600.00, and to authorize the Chair to sign the contractor contract. AGREEMENTS

DJ Buthe, Highway Superintendent, presented a Professional Services Agreement between Minnehaha County and Short Elliot Hendrickson, Inc. (SEH) for Project MC19-07, Structure 50-206-100 Replacement. SEH will provide construction administration at a cost not to exceed $67,038.10. The work is expected to begin in the Spring of 2020 and will be completed by November 13, 2020. MOTION by Karsky, seconded by Beninga, to authorize the Chair to sign the Professional Services Agreement between Minnehaha County and Short Elliot Hendrickson, Inc. for Project MC19-07, Structure 50-206-100 Replacement, construction administration at a cost not to exceed $67,038.10.  3 ayes.

DJ Buthe, Highway Superintendent, presented a Right-Of-Way Purchase Agreement for property owned by the City of Sioux Falls. In conjunction with Short Elliot Hendrickson Inc., the Highway Department will rebuild Structure 50-206-100 located in Sverdrup Township on Highway 122 (254th Street), approximately 0.5 miles west of South Dakota Highway 115. Additional right-of-way is needed for the building and maintenance of the proposed structure. The Quit Claim Deed for the properties will be filed by the Highway Department upon full execution of the agreement. MOTION by Karsky, seconded by Beninga, to approve the Right-Of-Way Purchase Agreements with the City of Sioux Falls for a total of $1.00 and other good and valuable consideration via Quit Claim Deed for the following properties: 1) Lot H-3 In The Southeast Quarter (SE¼) Of Section 21, Township 103 North, Range 49 West Of The 5th P.M., Minnehaha County, South Dakota, a total of 0.09 acres and 2) Lot H-2 In The Northeast Quarter (NE¼) Of Section 28, Township 103 North, Range 49 West Of The 5th P.M., Minnehaha County, South Dakota, a total of 0.10 acres.  3 ayes.

DJ Buthe, Highway Superintendent, presented two (2) Right-Of-Way Purchase Agreements for property owned by Roger A VanKeKerix and Jay & Tina Soderquist. In conjunction with JSA Engineers, the Highway Department is rebuilding County Highway 149 from County Highway 122 five and a quarter miles north to the Colton city limits. In order to meet safety standards, additional right-of-way is required. MOTION by Beninga, seconded by Karsky, to approve the following Right-Of-Way Purchase Agreements:

1) Land owned by Roger A. VanKeKerix will be purchased for the amount of $4,244.40, is a total of 0.524 acres, and is legally described as Lot H-2 In The East Half (E½) Of The Southeast Quarter (SE¼) Of Section 10, Township 103 North, Range 51 West Of The 5th P.M., Minnehaha County, South Dakota.

2) Land owned by Jay and Tina Soderquist, trustees of the Jay and Tina Soderquist Living Trust, will be purchased for the amount of $4,244.40, is a total of 0.524 acres, and is legally described as Lot H-2 In The Southwest Quarter (SW¼) Of Section 26, Township 104 North, Range 50 West Of The 5th P.M., Minnehaha County, South Dakota.

VOTE ON MOTION: 3 ayes.

DJ Buthe, Highway Superintendent, presented a Force Account Agreement between Minnehaha County and East River Electric Power Cooperative, Inc. (East River Electric) for utility relocation. Due to Highway Project MC17-01, County Highway 146 Reconstruction, utilities must be relocated. Minnehaha County will be responsible for the costs associated with utilities located within private easements. East River Electric will be responsible for the costs associated with the utilities located within the right-of-way. MOTION by Karsky, seconded by Beninga, to authorize the Chair to sign the Force Account Agreement between Minnehaha County and East River Electric Cooperative, Inc. for utility relocation for Highway Project MC17-01, County Highway 146 Reconstruction, at an estimated cost of $1,189,838.90. By roll call vote: 3 ayes.

TAX DEED PAYMENT PLAN

Bob Litz, Auditor, presented resolutions for the approval of property tax payment proposals on tax deed action for records 053008 and 40265. MOTION by Karsky, seconded by Beninga, to approve Resolution MC20-11 and Resolution MC20-12. By roll call vote: 3 ayes.

RESOLUTION MC20-11

APPROVAL OF PROPERTY TAX PAYMENT PROPOSAL ON

PARCEL RECORD 053008

WHEREAS, Minnehaha County has received notice from the owner of record that property taxes are delinquent by five years; and 

WHEREAS, a total of $8,246.42 in back taxes, penalties, and interest is owed on the property; and 

WHEREAS, the owner of record has requested support from the county to assist with re-payment options over a sixteen (16) month period; and

WHEREAS, the owner of record, Scott Smith, proposed the following payment plan to the county commission for consideration in order to satisfy all outstanding taxes, penalties, and interest:

• Initial Payment of $500.00 due by March 27, 2020. 

• Payment of $500.00 due by the last business day of each following month through June 2021. 

• Final Payment of any additional unpaid property taxes, plus any additional accrued interest and penalties due by 30th of July 2021. 

WHEREAS, in the event that the owner of record does not pay all back taxes, penalties and interest owing on property record 053008 in accordance with the aforementioned terms, Minnehaha County may proceed with the tax deed process.

NOW, THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners, the proposed payment plan, as described above is hereby approved for property record 053008.

RESOLUTION MC20-12

APPROVAL OF PROPERTY TAX PAYMENT PROPOSAL ON

PARCEL RECORD 40265

WHEREAS, Minnehaha County has received notice from the owner of record that property taxes are delinquent by four years; and 

WHEREAS, a total of $4,788.80 in back taxes, penalties, and interest is owed on the property; and 

WHEREAS, the owner of record has requested support from the county to assist with re-payment options over a twelve (12) month period; and

WHEREAS, the owner of record, Apostolic House of Deliverance, proposed the following payment plan to the county commission for consideration in order to satisfy all outstanding taxes, penalties, and interest:

• Initial Payment of $399.07 due by March 31, 2020. 

• Payment of $399.07 due by the last business day of each following month through February 2021. 

• Final Payment of any additional unpaid property taxes, plus any additional accrued interest and penalties due by 31st of March 2021. 

WHEREAS, in the event that the owner of record does not pay all back taxes, penalties and interest owing on property record 40265 in accordance with the aforementioned terms, Minnehaha County may proceed with the tax deed process.

NOW, THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners, the proposed payment plan, as described above is hereby approved for property record 40265.

RESOLUTION

Carol Muller, Commission Administrative Officer, presented a resolution establishing hourly rates for Board of Mental Illness activities. The request for the change in hourly rates came from Erin Johnson and Tom Weerheim, Chairpersons of the Minnehaha County Board of Mental Illness. The hourly rate would increase from $90.00, originally established in 2007, to $100.00 for the remainder of 2020. Effective January 1, 2021, the rate would increase to $110.00 per hour. MOTION by Beninga, seconded by Karsky, to approve Resolution MC20-13, Establish Hourly Rates For Board Of Mental Illness Activities. By roll call vote: 3 ayes.

RESOLUTION MC20-13

ESTABLISH HOURLY RATES FOR

BOARD OF MENTAL ILLNESS ACTIVITIES

WHEREASS, SDCL 27A-7-8 and 27A-10-6 provides that the County Board of Commissioners determine compensation rates for certain activities of the County Board of Mental Illness and establishes responsibility for the payment of certain expenses of the Board of Mental Illness, and

WHEREASS, the Chairman of the Minnehaha County Board of Mental Illness has recommended an increase in the rates for certain activities associated with the Board of Mental Illness, now

 THEREFORE BE IT RESOLVED BY the Minnehaha County Board of Commissioners that the following hourly rates are hereby established for Qualified Mental Health Professionals:

 • $100.00 per hour between March 15, 2020 and December 31, 2020 

• $110.00 per hour upon January 1, 2021 

BE IT FURTHER RESOLVED, these rates shall remain in place until changed by resolution by the Minnehaha County Board of Commissioners.

LEGISLATIVE UPDATE

Craig Dewey, Assistant Commission Administrative Officer, gave an update and status report on the 2020 Legislative Session bills that impact Minnehaha County highlighting House Bill 1293 and Senate Bill 157.

LIAISON REPORT

Commissioner Beninga reported on having a briefing regarding the Highway Department’s potential growth and relocation.

Commissioner Beninga reported on touring the Minnehaha County Jail with Commissioner Karsky that was very educational.

Commissioner Karsky reported on Jesse Fonkert being chosen as the new Executive Director of the Minnehaha County and Lincoln County Economic Development Associations.

Commissioner Bender reported on a February 28, 2020, meeting with Sheriff Milstead and Jason Gearman, Emergency Management Director. Mr. Gearman will give an update on plans for spring flooding and the coronavirus at the March 10, 2020, Commission Meeting.

Commissioner Bender reported on an initial meeting of the Building Committee’s Administration/Extension Building Planning Committee to discuss the process moving forward and inform department heads of what to expect.

MOTION by Karsky, seconded by Beninga, to adjourn.  3 ayes.

The Commission adjourned until 9:00 a.m. on Tuesday, March 10, 2020.
